Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Marine Manifest website, operator applications, and related services (the "Service"). By using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.

Marine Manifest provides a booking, reservation, operations, and payments platform for marine, tour, and activity operators, including scheduling, guest management, waivers, staff tools, and integrations. We may add, change, or remove features as we improve the Service.

You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and keep it current. Notify us immediately of any unauthorized use. Operators are responsible for managing access for their staff.

You agree not to:

• Use the Service for unlawful, fraudulent, or abusive purposes.
• Upload content that infringes the rights of others or that is harmful, misleading, or prohibited.
• Interfere with or disrupt the Service, its security, or its integrations.
• Attempt to access data or systems you are not authorized to access.
• Reverse engineer, resell, or sublicense the Service without our consent.

Operators pay a commission on completed bookings plus a payment processing fee per transaction, as described on our Pricing page. Fees may change with notice. Taxes, if any, are your responsibility. Unpaid balances may result in suspension of the Service.

Payments are processed through our third-party payment partners. Marine Manifest facilitates transactions but does not hold customer funds. Chargebacks, refunds, and disputes are handled in line with our policies and the rules of the applicable card networks and processors.

Operators define availability, pricing, and policies for their offerings. Guests make reservations subject to those policies. Marine Manifest is not a party to the contract between an operator and its guests and is not responsible for the conduct, fulfillment, or quality of any activity or experience booked through the Service.

Operators are responsible for the accuracy of their listings, compliance with applicable laws and licensing, safe operation of their activities, and honoring their own cancellation and refund policies. Operators indemnify Marine Manifest for claims arising from their operations or content.

Guests agree to provide accurate information, follow operator instructions, meet safety and eligibility requirements, and only book experiences they are qualified and able to participate in. Guests are responsible for reviewing operator policies before booking.

The Service, its design, branding, and software are owned by Marine Manifest and its licensors. Content you upload remains yours; you grant us a license to host, display, and process it to operate the Service. We respect intellectual property rights and may remove infringing material upon notice.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that any booking will be completed. Use of the Service is at your own risk.

To the fullest extent permitted by law, Marine Manifest and its affiliates, officers, and employees shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising from your use of the Service. Our aggregate liability is limited to the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold harmless Marine Manifest from claims, damages, and expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if we reasonably believe you present a risk, or as we discontinue features. Provisions that by their nature should survive — including ownership, disclaimers, liability, and indemnification — remain in effect after termination.

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, with notice where appropriate. Continued use after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles. Disputes will be resolved in the courts located in Honolulu, Hawaii, unless otherwise required by local consumer-protection law.
